M&S Lawyers Dispute Payments of Salary by Insolvent Debtor to the Former CEO of the Insolvent Debtor

What the Case Involved: Our client initiated insolvency proceedings against its debtor – a Russian limited liability company. Within the insolvency proceedings Marks&Sokolov on behalf of insolvency trustee filed claim on invalidation of payments made by the insolvent LLC to its former CEO as alleged  salary .
Result: The Court satisfied the claim in full, issued judgment on invalidation of the disputed payments and ordered former CEO to return to insolvent LLC the amount of $73,000 .

Юристы M&S добились признания недействительными действий несостоятельного должника по выплате заработной платы бывшему генеральному директору должника

Суть дела: Клиентом Маркс и Соколов было возбуждено  производство по делу о несостоятельности против своего должника — российского общества с ограниченной ответственностью. Компания Marks & Sokolov от имени управляющего в деле о банкротстве предъявила иск о признании недействительными платежей, произведенных несостоятельным ООО его бывшему генеральному директору, якобы, в качестве его заработной платы.
Результат: Суд удовлетворил иск в полном объеме, вынес решение о признании спорных платежей недействительными и обязал бывшего генерального директора вернуть сумму в размере $73 000 несостоятельному ООО.
