M&S Lawyers Quadruple Recovery After Appeal From Arbitration

What the Case Involved: Our client owned a rowhouse that sustained structural damages during excavation at an adjacent lot for a planned multi-unit apartment building.  The client, though prior counsel obtained a $50,000 award at arbitration, but the defendants appealed seeking a full trial.  With little pre-trial discovery completed, Marks & Sokolov took over the case just weeks before trial.
Result: The owner of the adjacent lot and general contractor agreed to settle paying $61,000 and we obtained a judgment against the excavation contractor in the amount of $208,108.

Суть дела: Клиент Маркс и Соколов, владелец таунхауса, который был структурно поврежден во время земляных работ на прилегающем участке, производимых для запланированного многоквартирного жилого дома.  В результате первоначального арбитражного производства клиент, взыскал $50,000 при посредстве адвоката, представлявшего в то время его интересы.    Ответчики обжаловали решение с требованием полномасштабного  судебного разбирательства.  Компания Marks & Соколов вошла в процесс  всего за несколько недель до начала судебного разбирательства и располагала весьма ограниченным кругом  доказательств, полученных на досудебной стадии.
Результат: владелец соседнего участка и генеральный подрядчик согласилась урегулировать спор мирным путем, в результате чего заплатили $61 000. Так же мы получили судебное решение, вынесенное против подрядчика по экскавационным  работам в размере $208,108.
